Lind Express ApS represents a new generation of transport companies, where efficiency, honesty and human contact go hand in hand. I work with simplicity, responsibility and respect for both you and your cargo, and believe that quality should be experienced, not marketed. These terms and conditions have been drawn up to ensure a solid, legal and fair foundation for working with Lind Express ApS.

Foundation and Definitions
§ 1

Definitions

Lind Express ApS: The carrier performing the transport.

The Customer: The company or person placing the transport order.

Cargo: Any material, equipment, documents or goods being transported.

Transport Solutions

On-Demand / Just-in-Time: Transport assignments carried out with dedicated capacity from start to finish. Direct door-to-door, with no reloading and no unnecessary stops.

Scheduled Transport: Transport with a fixed time window and route.

Roundtrip / Return Transport: Transport with dedicated capacity there and back.

Stay-over / Dedicated Transport: Transport involving an overnight stay or extended standby, including secure parking and storage of cargo where necessary.

§ 2

Bookings and Agreements

Acceptance: An assignment is only accepted once Lind Express ApS has confirmed it in writing.

Duty to Provide Information: The Customer must provide correct addresses, contact persons, weight, dimensions, access conditions and any special circumstances relating to the cargo.

Incorrect Information: Incorrect information may result in a price adjustment, additional waiting time, or refusal of the cargo, if no fair solution acceptable to both parties can be found.

§ 3

Unacceptable Shipments

Lind Express ApS does not transport the following:

  • Weapons and ammunition
  • Cash, currency and means of payment
  • Live animals
  • Medical samples, blood samples or biological material (requires a separate agreement)
  • Illegal goods or goods subject to sanctions
  • Explosives and radioactive materials (not handled under any circumstances)
  • Waste products, chemicals or environmentally hazardous material (requires a separate agreement)
  • Art, antiques, jewellery or goods of especially high value (requires a separate agreement)
  • Goods requiring temperature control (requires a separate agreement on equipment and handling)

Handling of Cargo
§ 4

Cargo Requirements and Handling

Customer's Warranties
  • The cargo is properly packaged in accordance with its type, weight and size
  • Weight and dimensions are correct and were provided at the time of booking
  • The cargo can be handled safely by one person without special equipment, unless otherwise agreed
  • Dangerous goods are correctly declared and accompanied by the necessary documents
  • The cargo is able to withstand road transport
  • The cargo is clearly labelled with the correct recipient, information and any handling instructions
  • Access conditions at the pickup and delivery addresses are suitable for safe handling

Consequences of Deficiencies: Inadequate packaging or incorrect information may result in a price adjustment, additional waiting time, or refusal of the cargo, if no fair solution acceptable to both parties can be found.

§ 5

Right of Inspection

Lind Express ApS may open and inspect cargo without notice if there is suspicion of illegal contents, damaged packaging, or a requirement from the authorities. Inspections are documented with photographs and a written note, and the Customer is contacted as soon as possible. Any delays resulting from an inspection do not release the Customer from liability for payment.

§ 6

Transport, Delivery and Waiting Time

Transport Type: The transport type clearly describes what can be expected. There is no deviation from the agreed transport type unless otherwise agreed in writing between all parties involved. No reloading, combined transport or terminal handling takes place without a prior request or requirement from the Customer, or in the event of force majeure.

Waiting Time: A combined total of 30 minutes for loading, unloading and cargo inspection at both the sender and the recipient is included in the price. Beyond this, each commenced 15-minute period is invoiced at the applicable rate. Waiting time arises from circumstances outside the control of Lind Express ApS, including lack of access, delayed preparation, or general waiting time at the recipient or sender.

§ 7

Failed Delivery

A failed delivery is invoiced in full if no fair solution can be found. In such cases, the cargo is returned at the Customer's expense. A failed delivery includes, but is not limited to:

  • Refusal to accept delivery
  • The recipient is not present or cannot be contacted within a reasonable time
  • The recipient lacks the equipment or capacity to receive the cargo
  • Access conditions prevent safe unloading

The above circumstances are considered a breach of the agreement. Lind Express ApS reserves the right to decline future business with parties who do not comply with these terms.

§ 8

Return, Storage and Destruction

Return: Return transport is at the Customer's expense, unless otherwise agreed in writing. Returns are carried out as direct transport at the applicable rate, and the Customer is informed before departure.

Storage: If cargo is not collected or the matter remains unresolved, it may be stored temporarily. Storage is invoiced at DKK 150 excl. VAT per day per package. The maximum storage period is 14 days, unless otherwise agreed in writing. After this period has expired, the cargo may be returned or destroyed at the Customer's expense.

Destruction: Illegal cargo, or cargo that cannot be returned due to requirements from the authorities, may be destroyed without compensation. Destruction is documented with photographs and a written note, and the Customer is informed unless prevented from doing so by the authorities.

§ 9

Conditions at Pickup and Delivery

  • Inadequate packaging or insufficient securing of cargo may result in refusal
  • A lack of unloading equipment at the recipient is invoiced as a failed delivery
  • Incorrect information regarding addresses, access conditions or opening hours may result in waiting time or a return trip
  • The Customer must ensure that the recipient has been informed and is able to receive the cargo
  • Cargo requiring special handling requires a prior agreement

Liability, Insurance and Compensation
§ 10

Liability and Insurance

Insurance: Lind Express ApS holds cargo liability insurance of up to DKK 1,000,000 through IF Forsikring. Extended cover can be purchased by agreement.

Exclusions: The insurance does not cover inadequate packaging, hidden damage, or circumstances outside the control of Lind Express ApS.

Declared Value: The Customer is responsible for declaring the correct value.

Limitation of Liability: The liability of Lind Express ApS cannot exceed the actual insurance cover or the documented value of the cargo.

Third-Party Liability: Lind Express ApS cannot be held liable for damage or loss resulting from circumstances outside the company's control, including road conditions, requirements from the authorities, or force majeure.

§ 11

Limitation of Liability

Lind Express ApS is not liable for operating losses, loss of profit, indirect loss, consequential damage, or loss resulting from delay, unless otherwise required by mandatory legislation. This limitation ensures a reasonable allocation of liability between the parties and applies regardless of the cause of the loss.

§ 12

Compensation

Total Loss: Compensation is set at the documented net value at the time of the damage.

Damage: Compensation is calculated on the basis of the repair cost.

Special High-Value Items: Only by separate written agreement.

Documentation and Limits: Compensation is only paid against documented value and relevant evidence of the damage or loss. Compensation cannot exceed the applicable insurance cover.

§ 13

Claims

A claim must be submitted in writing no later than 7 days after delivery, and must include photographs, a description, the delivery document, and any proof of purchase. Visible damage must be noted at the time of receipt.

Claims submitted after 7 days will be rejected and will not be processed. A claim forms the basis for assessing any compensation but does not automatically result in payment.

§ 14

CMR: International Liability and Compensation

All international transport is carried out in accordance with the CMR Convention (Convention relative au contrat de transport international de marchandises par route). The Convention establishes clear and uniform rules on liability, compensation and documentation, regardless of where in Europe the transport takes place, and ensures transparency and a consistent basis in the event of any damage or irregularities.

Finance and Payment Terms
§ 15

Prices and Surcharges

Prices are set according to the price list applicable to Lind Express ApS at any given time. The rate per kilometre, surcharges and minimum price are shown in the price list. Any changes are communicated directly and accompanied by a brief explanation.

On-Demand / Just-in-Time: Urgent transport without prior planning is subject to a surcharge of 50% of the trip price.

Transport Outside Normal Working Hours: Transport on weekdays between 17:00 and 07:00 is subject to a fixed surcharge of DKK 500. Transport at weekends and on public holidays is subject to a fixed surcharge of DKK 1,000. These surcharges apply regardless of transport type and may apply at the same time as the On-Demand surcharge.

Prices are adjusted once a year in line with general price trends and the relevant transport and consumer price indices published by Statistics Denmark. All prices are exclusive of VAT.

§ 16

Payment

Payment is made by invoice with a net payment term of 8 days, unless otherwise agreed in writing. A deposit may be required for exceptionally long transport assignments or when handling cargo of significant value. Cash payment is not accepted. All prices and payments are in Danish kroner (DKK).

Reminder Procedure
  • First reminder: DKK 100
  • Second reminder: DKK 100
  • Third reminder: Referred to debt collection
  • Interest of 1.5% per commenced month is charged on late payment
§ 17

Cancellation and Changes

Cancellation
  • At least 24 hours before scheduled pickup: no charge
  • At least 12 hours before: 25% of the trip price
  • Less than 60 minutes before pickup: 100% of the trip price

Changes: Changes must be reported as soon as possible. Any changes to time, location or scope are assessed individually and may result in an adjustment to the price or schedule.

External Factors and Legislation
§ 18

Force Majeure

Lind Express ApS is not liable for delays, failure to deliver, or other circumstances arising from events outside the company's control. Force majeure includes, but is not limited to:

  • Extreme weather conditions
  • Accidents or technical breakdowns
  • Requirements or restrictions imposed by the authorities
  • Strikes or industrial action
  • Cyberattacks or system failures
  • Pandemics or epidemics
  • Closed bridges or tunnels, or cancelled ferries
  • War, terrorism or civil unrest
  • Natural disasters
  • Major traffic disruption or roadworks

In the event of force majeure, the obligations of Lind Express ApS are suspended for as long as the circumstances persist. The company cannot be held financially liable for loss, delay, or consequential costs directly or indirectly caused by these circumstances.

§ 19

Customs and International Matters

The Customer is responsible for preparing and providing all necessary customs documents, duties and statutory information in connection with transport across national borders. Lind Express ApS disclaims liability for delays, additional costs, or refusal of cargo resulting from missing, incorrect or incomplete documentation.

§ 20

Legislation and Compliance

All transport is carried out in accordance with applicable Danish and European legislation, including the Mobility Package, rules on driving and rest periods, tachograph regulations, working environment requirements, and data protection (GDPR). Delivery times may be adjusted to accommodate statutory breaks, secure parking arrangements, and other requirements for safe transport.

§ 21

Carrier's Obligations

Lind Express ApS undertakes to carry out all transport in full compliance with applicable legislation, safety standards and regulatory requirements.

Valid Documentation and Permits
  • Valid driving licence
  • Valid driver card (Smart Tachograph V2)
  • Valid van operator's licence
  • Valid Community licence for international van transport
  • Valid Certificate of Professional Competence (CPC)
  • Valid and correct insurance
  • Valid ADR certificate where relevant to the transport
Vehicle and Equipment
  • A roadworthy and well-maintained vehicle
  • Safety equipment: fire extinguisher, high-visibility vest, safety footwear, safety helmet, first aid kit
  • All equipment necessary for the specific assignment, including ADR equipment and load-securing materials where applicable
  • Driving is carried out defensively and responsibly, in compliance with traffic regulations in Denmark, the EU and Scandinavia
  • Safety always takes priority over deadlines
  • Driving is adapted to weather, traffic and cargo type
  • Environmental impact is minimised through efficient planning and operations

Data Protection and Confidentiality
§ 22

Confidentiality and Data Processing

All information is treated confidentially and in accordance with applicable data protection legislation (GDPR). Sensitive personal documents and information are handled with full discretion. Data is stored and processed only to the extent necessary to carry out transport assignments and invoicing, and is deleted or anonymised once the purpose has been fulfilled.

§ 23

Data Protection (GDPR)

Lind Express ApS only collects and processes the information necessary to carry out transport assignments correctly, including contact details, delivery addresses, documentation and any photographs of cargo. All data is stored securely and is never shared with third parties without a lawful basis. Data is deleted or anonymised within the timeframes required by the EU General Data Protection Regulation (GDPR).

Disputes, Purpose and Validity
§ 24

Disputes and Jurisdiction

Any disputes are settled under Danish law, with the Odense District Court (Retten i Odense) as the venue, unless mandatory legislation requires otherwise. This applies regardless of the Customer's nationality or place of delivery.

§ 25

Purpose

These provisions ensure:

  • Correct and safe handling of cargo
  • Clear expectations between the parties
  • Responsible and efficient operations
  • Minimisation of errors, waiting time and misunderstandings
  • A professional and reassuring transport experience
§ 26

Validity and Amendments

These terms and conditions apply to all transport assignments carried out by Lind Express ApS, unless otherwise agreed in writing. Lind Express ApS reserves the right to amend these terms with reasonable notice. Updated terms are published digitally and take effect from the next booking or agreement entered into. Previous versions are automatically superseded once new terms come into effect.
